{"id":"20468965","number":"71.06","gazettalDate":"2018-07-30T14:00:00Z","amendmentNumber":"VC148","semanticNumber":"71.06","title":"OPERATION OF VICSMART APPLICATIONS AND PROCESS","content":"","sections":[{"id":"20468966","number":"71.06-1","gazettalDate":"2025-10-15T13:00:00Z","amendmentNumber":"VC288","semanticNumber":"71.06-1","title":"VicSmart applications","content":"<p>Any provision of this planning scheme may specify:</p><ul><li><p>Classes of application that are VicSmart applications to which clause 71.06 applies.</p></li><li><p>Information and other requirements for each class of VicSmart application.</p></li><li><p>Decision guidelines for each class of VicSmart application.</p></li></ul><p>An application is a VicSmart application if all of the following requirements are met:</p><ul><li><p>The application is in a class or classes specified in a provision of this planning scheme.</p></li><li><p>A permit is required only under the provisions of this planning scheme that are specified as a VicSmart application, and not under any other provision of this planning scheme.</p></li><li><p>Nothing authorised by the grant of a permit would result in a breach of a registered restrictive covenant.</p></li><li><p>If the application requires referral to a referral authority under clause 66, the referral requirements in clause 71.06-2 are met.</p></li></ul>","state":{"active":true}},{"id":"20468967","number":"71.06-2","gazettalDate":"2025-10-15T13:00:00Z","amendmentNumber":"VC288","semanticNumber":"71.06-2","title":"VicSmart process","content":"<p>Despite any other provision of this planning scheme:</p><ul><li><p>A VicSmart application is exempt from the requirements of the Act and planning scheme specified in this clause.</p></li><li><p>The responsible authority must assess a VicSmart application in accordance with the requirements of this clause.</p></li></ul><p>If there is any inconsistency between the requirements of this clause and another provision of this planning scheme, this clause prevails.</p><h3>Referral requirements</h3><p>If an application requires referral to a referral authority under clause 66:</p><ul><li><p>The application must have been considered by the referral authority within the past 3 months of the application being made to the responsible authority. </p></li><li><p>The referral authority must have stated in writing that it does not object to the granting of the permit for the proposal.</p></li></ul><h3>Information requirements</h3><p>A VicSmart application must be accompanied by the information requirements specified for the relevant class of application. The information requirements of the relevant zone, overlay or particular provision, other than those specified for VicSmart applications, do not apply unless the information requirements for the relevant class of application specify otherwise.</p><p>If in the opinion of the responsible authority an information requirement is not relevant to the evaluation of a VicSmart application, the responsible authority may waive or reduce the information requirement.</p><h3>Exemption from notice and review </h3><p>A VicSmart application is exempt from:</p><ul><li><p>The notice requirements of section 52(1)(a), (b), (c) and (d) of the Act.</p></li><li><p>The decision requirements of section 64(1), (2) and (3) of the Act.</p></li><li><p>The review rights of section 82(1) of the Act.</p></li></ul><h3>Matters to be considered</h3><p>In deciding a VicSmart application, the responsible authority:</p><ul><li><p>Must only consider:&nbsp;</p><ul class=\"\"><li><p>The decision guidelines and requirements&nbsp;specified for the relevant class of application.</p></li><li><p><span data-contrast=\"auto\" lang=\"EN-AU\">T</span><span data-contrast=\"auto\" lang=\"EN-AU\">h</span><span data-contrast=\"auto\" lang=\"EN-AU\">e</span><span data-contrast=\"auto\" lang=\"EN-AU\"> following</span><span data-contrast=\"auto\" lang=\"EN-AU\"> </span><span data-contrast=\"auto\" lang=\"EN-AU\">requirements </span><span data-contrast=\"auto\" lang=\"EN-AU\">that would otherwise be applicable</span><span data-contrast=\"auto\" lang=\"EN-AU\"> to an applicat</span><span data-contrast=\"auto\" lang=\"EN-AU\">ion if it were not a VicSmart application:</span></p><ul><li><p>A public open space requirement in clause 53.01 or clause 43.06-8 or a schedule to those clauses.</p></li><li><p>A minimum garden area requirement and a maximum building height requirement in a residential zone or a schedule to a residential zone.&nbsp;</p></li></ul></li></ul></li><li><p>Is exempt from considering the following matters:</p><ul><li><p>The requirements of section 60(1)(b), (c), (e) and (f) and (1A) (b) to (h) and (j) of the Act.</p></li><li><p>The Municipal Planning Strategy and Planning Policy Framework unless the decision guidelines for the relevant class of application specify otherwise.</p></li><li><p>The decision guidelines of the relevant zone, overlay or particular provision, other than those specified for VicSmart applications, unless the decision guidelines for the relevant class of application specify otherwise.</p></li><li><p>The decision guidelines in clause 65.</p></li></ul></li><li><p>In deciding an application for review in relation to a VicSmart application, the Tribunal is exempt from the matters specified in section 84B(2)(b) to (g) and (i) to (ja) of the Act.</p></li></ul><h3>Decision guidelines</h3><p>Before deciding a VicSmart application, the responsible authority must consider the decision guidelines specified for the relevant class of application unless in the opinion of the responsible authority a decision guideline is not relevant to the evaluation of the application.</p><p><span data-contrast=\"auto\" lang=\"EN-US\" class=\"\"><span data-ccp-parastyle=\"Body Text\">Before deciding a </span><span data-ccp-parastyle=\"Body Text\">VicSmart</span><span data-ccp-parastyle=\"Body Text\"> application to which clause 55 applies, the responsible authority must, if a standard in clause 55 is not met, </span></span><span data-contrast=\"auto\" lang=\"EN-US\" class=\"\"><span data-ccp-parastyle=\"Body Text\">consider the decision guidelines for the corresponding </span><span data-ccp-parastyle=\"Body Text\">objective</span><span data-ccp-parastyle=\"Body Text\">.</span></span></p><p>Before deciding a VicSmart application to which clause 54 applies, the responsible authority must, if a standard in clause 54 is not met, consider the decision guidelines for the corresponding objective.&nbsp;</p>","state":{"active":true}}],"state":{"active":true}}
